Star Polaris LLC v HHIC-Phil Inc (The "Star Polaris") [2016] EWHC 2941 (Comm)

Meaning of "consequential losses": shipbuilding contracts. By entering into a shipbuilding contract on an amended SAJ (Shipbuilders' Association of Japan) standard form dated 6 April 2010, the defendant shipyard agreed to construct and sell, and the claimant buyer agreed to buy, the vessel Star Polaris, a Capesize bulk carrier.

Under article IX of the contract, the shipyard guaranteed that the vessel was free of defects for a period of 12 months from the date of delivery of the vessel to the buyer. Article IX also provided, inter alia, the method of notification of defects and the obligations on the shipyard in relation to repair or replacement of the defective parts or materials.
