Commercial lease – alienation provisions – alleged breach by tenant – interpretation and construction


Lunar Office SARL v Warborough Investments Ltd [2017] EWHC 19 (Ch) (Richard Millett QC sitting as a deputy judge of the High Court) (13 January 2017)


This is another case where drafting has given rise to difficulties and the court was called upon to provide clarity. The case also raised an interesting point on the application of s19(1)(b) Landlord and Tenant Act 1927 where the reversion to a lease originally granted by a public body had been assigned to a non-public body. Unhappily, and in the event, the judge did not have to decide this point.
