Reinsurance - Claims Co-operation Clauses

(Gan Insurance Co Ltd v Tai Ping Insurance Co Ltd (No 3), (forthcoming in [2001] Lloyd's Rep IR))

Although claims co-operation clauses are widely used in the London reinsurance market, there is relatively little authority on their scope and effects. The decision of Andrew Smith J in Gan Insurance Co Ltd v Tai Ping Insurance Co Ltd (No 3), forthcoming in [2001] Lloyd’s Rep IR, demonstrates that the obligations imposed by such clauses are perhaps not as demanding as some in the market may believe. Earlier proceedings between the parties were considered in the April 2001 issue of Insurance Law Monthly , although some of the matters there discussed are briefly summarised here in order to provide a complete picture of the dispute.
