Claims - The Investigation of Fraud

(Prentice v Hereward Housing Association and East Cambridgeshire District Council, (forthcoming in [2001] Lloyd’s Rep IR))

The decision of the Court of Appeal in Prentice v Hereward Housing Association and East Cambridgeshire District Council , forthcoming in [2001] Lloyd’s Rep IR raises the important question of whether an insurer is able to raise allegations of fraud based on evidence discovered after the assured has received a judgment upholding his claim. The judgment contains some interesting observations as to the circumstances in which a new trial can be ordered.
