MOTOR VEHICLE INSURANCE - CIVIL LIABILITY FOR AUTHORISING UNINSURED DRIVING

(Norman v Aziz [2000] Lloyd’s Rep IR 52)

The short question before His Honour Judge Kershaw QC in Norman v Aziz , forthcoming in [2000] Lloyd’s Rep IR 52 , was whether the various changes made to the compulsory insurance rules in the road traffic legislation since their inception in 1930 have affected the early ruling in Monk v Warbey and Others [1935] 1 KB 75 that failure to insure gives rise to civil liability. The facts which gave rise to the dispute in Norman v Aziz are not apparent from the judgment, and this note will concentrate on the legal issues involved.
