(2) Mohamud v Morrison Supermarkets plc (2016) 310 LRI 4, Personal Injury Compensation Volume 32 Number 2, [2016] UKSC 11, 2 March 2016

This is the second Supreme Court judgment on vicarious liability, together with Cox v Ministry of Justice [2016] UKSC 10. This appeal concerned a supermarket customer who had been assaulted by an employee at one of the supermarket’s fuel stations. The question for the Supreme Court was that of how the conduct of an individual has to be related to the employer/employee relationship, and in particular the “close connection” test in order for vicarious liability to be imposed on the defendant.
