A. The Maritime Code (MC) etc.
Nationality and registry
After the ECJ’s Factortame judgments (Factortame 11 [1991] I ECR 3905 and others), the Swedish legislature felt pressed to widen the Maritime Code nationality and registry rules to allow Swedish nationality and registry to citizens and legal persons in the EU. In face of criticism of proposed rules infringing international law, Sweden went far in compliance with EU signals by introducing complicated amendments (Act 1997:266) of Ch. 1 of MC (available in English from the Maritime Law Institute, Stockholm) and the Act (1979:377) on Boat Registry, amended (1997:267).
B. Vessels
1. Vessel Safety Act (1988:49) and Ordinance (1988:594)
Amendments (1997:339) according to EU Directive 94/57/EG on standards of inspection and approval (by Maritime Administration) of Classification Societies (Government Bill 1995/96:219).
2. Vessel Measurement Ordinance (1994:1162)
Amendments (1997:682) involving measuring duty for all Swedish ships subject to registration and certain other vessels subject to transport dues.
