I. LEGISLATION

1. The Maritime Code (MC 1994:1009)

MC Amendment Act (1998:365). The reservation in MC 21:2 5th para. for application of the Act (1992:794) of accession to the Lugano Convention extended to the Act (1998:358) of accession to the Brussels Convention.
Ordinance (1998:1421) amending the Instruction for the Maritime Administration, granting the Administration free determination of charges and disposal of income.

2. Vessels

Amendment Act (1998:310) on the Swedish Ship Mortgage Bank widening the definition of beneficiaries into “foreign legal person where a Swedish physical or legal person has a decisive influence or interest”.
Amendment Act (1998:1574) on Good Faith Acquisition of Chattels. Good faith acquisition of chattels allows a good faith purchaser of a stolen boat to become the owner. The Act sharpens requisites for good faith. However, through Directive (1998:95) the Government has initiated an investigation for replacing the good faith purchase for stolen goods by invalidity, whereby a purchaser will not acquire title.

3. Personnel

Amendment Act (1998:958) and Ordinance (1998:962) relating to Seamen’s Hours of Rest.
New Ordinance (1998:965) on Competence Requirements for Sea Personnel.

The terminology of this presentation follows that of Swedish Law, first edn, Juristförlaget Stockholm 1994, and the explanatory notes in the Swedish Maritime Code (Sjö och transporträtt No. 16, Stockholm 1995). Cases not reported in recognized journals are cited by court name and case number, and reported cases are referred to by the recognized report name. “Fines” indicates so-called day fines adjusted to a convicted person’s income; while “fine” in the singular indicates a monetary fine.
