Terminal dilapidations – damages where landlord does not propose to carry out works of repair

In our November 2014 issue Commercial Leases [2014] Vol 28 Issue 9 at p2121 we highlighted the first instance decision in this case. On appeal Scotland’s Court of Appeal (Court of Session Inner House) has reversed that decision and has found in favour of the landlord. We summarise the appeal decision in brief to raise awareness.
