Cargo claim - Liability for contamination of Alpha Methyl Styrene

The owners of the vessel Maasstroom entered into a charterparty on the Asbatankvoy form for the carriage of a parcel of 500 tonnes of Alpha Methyl Styrene (“A.M.S.”) 5% more or less from the Baytank Terminal, Seabrook, Texas to Ulsan, Korea. The cargo was shipped by barge from Ironton, Ohio, to the Baytank Terminal, where it arrived on 15 March 1987 and was discharged into a shore tank, a tank which was dedicated to A.M.S. and which already contained a certain quantity of the product.
