In this case the Court of Appeal was required to focus on the practical steps where a litigant in person meets with the solicitor to the claimant and discusses the case. Our summary is fairly full because the Court considers and restates the general principal of without prejudice privilege and whether such privilege as may attach had been abused and/or waived.
