Charterparty – Synacomex 90 form – Contracts of carriage of bags of rice incorporating Synacomex 90 charterparty – Claimant cargo interests alleging cargo damage and short delivery – Whether incorporated charterparty transferred responsibility for loading and stowage from carrier to charterers/cargo interests

By a contract of carriage contained and/or evidenced in bills of lading incorporating the Hague Rules and a charterparty on the Synacomex 90 form, the first defendant (the carrier) carried two consignments of 453,089 bags of rice on the vessel Sea Miror from Karachi in Pakistan to Abidjan in the Ivory Coast.
