Carriage of goods by sea – Lien – Carrier seeking to exercise lien on cargo for non-payment of freight – Whether carrier had contractual lien

The second respondent (Mr Murphy) engaged the first respondent (Leisure) to arrange the carriage of his yacht Sea Ray 400 from the United States to Australia. Leisure, in turn, contracted with the applicant carrier (US Shipping) to carry the vessel from the United States to Fremantle, Australia.
