Insurance Act 2015: potential impact on non-disclosure and misrepresentation litigation

The UK’s Insurance Act 2015 received royal assent a little more than two months ago and was described by the government as "the biggest reform to insurance contract law in more than a century". When it comes into force in August 2016, it will amend key parts of the Marine Insurance Act 1906. In doing so, it will introduce substantial changes to the law governing warranties and other contractual terms; insurers' remedies for fraudulent claims; and pre-contractual disclosure duties in non-consumer contracts.
