The meaning of ‘dispute’

In the April 2005 issue of Arbitration Law Monthly there was discussion of the decision of Jackson J in Amec Civil Engineer ing Ltd v Secretary of State for Transport , the main issue in which was the meaning of ‘dispute’. That case was appealed to the Court of Appeal, and in March 2005 – days after that issue went to press – the judgment of Jackson J was upheld: see [2005] EWCA Civ 291. The decision of the Court of Appeal is considered in the following paragraphs.
