The definition of arbitration

Arbitration subject to condition

The distinction between arbitration and other dispute resolution processes is often a fine one, but it is crucial as arbitration legislation applies only to arbitration and not to anything else. The New South Wales Supreme Court in Savcor v State of New South Wales [2001] NSWSC 596 was required to classify an agreement which had elements of arbitration and other processes. Related questions arose before the Hong Kong Court of Appeal in China Merchants Heavy Industry Co v JGC Corporation , July 2001.
