Amount of PPI commission rendered agreement unfair

Plevin v Paragon Personal Finance Ltd and Another [2013] EWCA Civ 1658 SC TLR 28 November

Where a purchaser of payment protection insurance (PPI) had not been told prior to concluding the agreement that more than two-thirds of the premium would be used to pay commission to intermediaries, the agreement was unfair and could be reopened by the court pursuant to its powers under the Consumer Credit Act 1974.
