Arbitration - Foreign award - Enforcement of award set aside by curial courts - No provision for interest in award - Whether English court could award interest until date of payment of award - Senior Courts Act 1981, section 35A

Rosneft was required to pay Yukos RUB12,935,858,470 and US$857,507. The awards were set aside by the Russian courts in 2007, but in June 2010 the Dutch Supreme Court held that the Russian judgments were not to be recognised in Holland and permission was given to enforce the awards. The sums due under the awards were paid in August 2010. In the present case Yukos sought interest from the date of the award up to the date of payment.
