Charterparty (time) - Injurious cargoes - Cargo of LNG said to be contaminated by metal particles
On the evidence, the claimant shipowner had not established
that the defendant charterer's cargo of LNG had been so contaminated by metal
particles as to cause damage to the vessel. The relevant clause in the
charterparty read: "No acids, explosives or cargoes injurious to the Vessel
shall be shipped and without prejudice to the foregoing any damage to the
Vessel caused by the shipment of any such cargo, and the time taken to repair
such damage, shall be for Charterers' account".
