Tort – US warship diverting plaintiff’s chartered cargo vessel in international waters – UN arms embargo on Libyan government – Plaintiff suing US government in tort – Whether action justiciable

The plaintiff brought a tort action against the USA (the government) pursuant to the Suits in Admiralty Act 46 USC § 30901 and the Public Vessels Act 46 USC § 31101 to recover damages allegedly incurred when a US warship, USS Stout, blockaded and diverted the plaintiff’s chartered cargo vessel Vento Di Ponente ( Vento) in international waters near Tripoli, Libya in March 2011 during Joint Task Force Operation Odyssey Dawn.
