This was a request for a preliminary ruling from the Tribunale di Genova (Italy) in
proceedings between, on the one hand the owner and the captain of MSC Orchestra, and on the other hand the
Genova Port Authority regarding an administrative penalty issued by the port authority
in respect of the sulphur content of fuel. The Directive was concerned with
achieving a reduction in the sulphur content of certain liquid fuels and
imposed a lower limit than Annex VI of MARPOL (the 1997 Protocol).
