Cosmotrade SA v Kairos Shipping Ltd and Others (The “Atlantic Confidence”) – QBD (Comm Ct) (Simon J) [2013] EWHC 1904 (Comm) – 21 June 2013

Limitation – Whether limitation fund can be constituted by provision of P&I Club guarantee

On 3 April 2013 the bulk carrier Atlantic Confidence sank off Masirah Island, Oman, following a fire which broke out in the engine room. The likely cause of the loss was the ignition of a leak of oil from a hot exhaust from a generator causing subsequent thermal stresses to the plating or damage to the seawater pipes in the engine room.
