Charterparty – Vessel failing pre-loading inspection – Claim for off hire and damages

The vessel, a Handymax bulk carrier, was trip-chartered on an amended Asbatime 1981 form to load a cargo of Brazilian sugar. The vessel delivered on arrival at the Santos pilot station on 8 May 2012. Shortly afterwards, the holds and hatch covers were inspected and failed by the shippers’ surveyor.
