Arbitration - Permission to serve out of the jurisdiction - Interim anti-arbitration injunction to restrain pursuit of arbitration proceedings in Singapore - Identification of true parties to a charterparty
The applicant sought permission to serve an arbitration
claim form out of the jurisdiction on the defendants HIT and G and for an
interim "anti-arbitration" injunction to restrain G from pursuing arbitration
proceedings in Singapore. The application arose out of a dispute as to which of
the defendants was party as disponent owner to a charterparty under which the
vessel Barito was chartered to the claimant in March 2008 for 11 to 13
months. The claim form was in respect of a declaration that the charterparty
was between the claimant and HIT; and enforcement of an obtained award,
including judgment for sums due to the claimant under the award, and the
granting of such declarations and injunctions to enforce the award as may be
just.
