Agreement for lease – construction – practical completion – validity of certificate - consequences – specific performance

Kingerlee Holdings Ltd v Dunelm (Soft Furnishings) Ltd [2013] EWHC 47 (Ch) (Mann J) (21 January 2013)

This case concerns an agreement to take a lease of premises to be constructed on a retail park to be occupied by three retailers. The principal issue turns on whether proper certificates were given as provided by the agreement which, in turn, trigger the date from which rent becomes payable.
