Marine insurance - Claim for damage following cyclone whilst vessel laid up in Mahajanga - Whether claims made out - Whether claimant in breach of warranty - Whether vessel required to comply with port regulations during lay up

The claimant was the owner of the fishing vessel Agios Spyridon which was insured under a policy of marine insurance which stated: “Warranted vessel laid up from 1/11/06 until 28/2/07 BDI in port of Mahajanga [Madagascar]…”.
