Construction of a notice to terminate a licence to use land

Whilst on the question of construction of instruments we mention this case in brief. Although the case concerned a licence the underlying principle is of equal application to tenancies.

The background

A farmer, Harry Fitzhugh senior, died intestate and his nine children inherited his substantial estate. Four sons were granted letters of administration. Two of those sons subsequently died leaving Anthony and Harry Jr administering the estate. The estate comprises a number of parcels of land.
