In our June 2011 issue, Commercial Leases Vol 25 Issue 5 at p1713 we highlighted a couple cases concerning the failure of the landlord (or its letting agent) to comply with the residential tenancy deposit scheme (TDS) to protect the deposit which gave rise to some practical issues.
