Arbitration was under way in Singapore in respect of an Operating Agreement - Mining Services, pursuant to which Thiess was a sub-contractor to KPC on a coal extraction project. The dispute before the English court arose under a Cash Distribution Agreement whose terms Thiess said it was entitled to enforce and whose provisions included an English law and jurisdiction clause.
