No leading questions to ECJ

SAS Institute Inc v World Programming Ltd [2010] EWHC 1829 (Ch); TLR 11 February

The court dismissed an application by the claimant for the amendment of certain questions he had referred to the European Court of Justice concerning the interpretation of a Council Directive. It is well established that questions referred to the European Court of Justice are the referring court’s questions and it is for that court to formulate its questions.
