Surviving the US oil spill

Charles Anderson, of Skuld North America, asks whether the limitation of liability for US oil pollution will survive the Deepwater Horizon spill

The recent tragic loss of the Deepwater Horizon rig and the ongoing environmental disaster in the Gulf of Mexico have inevitably led to calls for increases and even removal of the liability limits currently in place under the US Oil Pollution Act of 1990 (OPA-90).
