Comparative perfume advertising

L’Oreal SA and others v Bellure NV and others [2010] EWCA Civ 535, TLR 14 June

The claimant produced and marketed luxury perfumes and alleged that the defendants, the producers of imitation fine fragrances and two companies which marketed them had infringed their trade marks by offering a range of products to retailers with lists which compared the smell of each product with a product of the claimant which was being imitated.
