R (Coombes) v Waltham Forest LBC, QBD, TLR 11 May

Stanley Coombes by way of judicial review sought a declaration in relation to proceedings for possession of a flat brought against him by the local council that s3 of the Protection from Eviction Act 1977 was not compatible with arts 6 and 8 of the European Convention of Human Rights because personal circumstances could not be relied on by way of defence.
