Leonard Kernott and Patricia Jones bought a property in their joint names in which they lived together for eight years from 1985 to 1993 when they separated. Since then the defendant had lived in the property with their two children and paid the mortgage. The claimant made a claim under the Trusts of Land and Appointment of Trustees Act 1996 (TOLATA 1996).
