The Court of Appeal dismissed the defendant local authority’s appeal against a finding that it was liable for the claimant’s
mesothelioma. The claimant had been negligently exposed to asbestos above a minimal level in two ways whilst a pupil at the
defendant’s school in the 1970s. Once exposure above a minimal level is found, a risk of harm – and hence causation – is established.
