Charterparty – Demurrage – Whether berth or port charter

On 5 February 2007 the vessel Merida was chartered for the carriage of a part cargo of steel plates, from Xingang to Cadiz and Bilbao. The charterparty was solely contained in a “recap” which did not refer to a pro-forma. The charterparty provided inter alia:
