HEALTH NON-DISCLOSURE BARS POP STAR'S CLAIM
German mutual insurer Gothaer been backed by Cologne District Court in its decision to deny a EUR3.5m ($5.25m) claim by the
organizers of a cancelled 40-date music tour. German
volkstümliche Musik/Schlager legend Heino had arranged a series of concerts through Kult Musik, in which Heino is a stakeholder, but was forced to pull
out when he suffered a heart-related illness in the US. Gothaer declined the claim on the grounds that Heino had concealed
information about ill health when applying for the policy. Heino told the court that "I was never sick in my whole life",
but Gothaer showed that he had consulted doctors 120 times in two years, obtaining 600 sleeping pills. Heino claimed that
he did not take the tablets but gave them to his wife and colleagues.
