Arbitration – Jurisdiction – Arbitration Act 1996, section 67

The arbitrators ruled in procedural directions that a counterclaim by the respondent fell within the scope of their jurisdiction. That ruling was challenged by the applicant by means of an appeal under section 67 of the Arbitration Act 1996. It was held that the directions did not constitute an award and that no challenge could be made under section 67.
