Marsden v Bourne Leisure [2009] EWCA Civ 671

The claimants’ two-year-old boy was drowned in a pond in a holiday park in Wales. They were awarded £25,000 damages in the county court on the grounds that the defendant had breached its duty of care by not giving them specific warnings about lakes and ponds near their caravan as required by the Occupiers’ Liability Act 1957.
