Significant increase in income

Hvorostovsky v Hvorostovsky [2009] EWCA Civ 791; SJ 4 August; LSG 6 August

The respondent former husband was a successful singer. Ancillary relief proceedings had been compromised at a time when the husband’s gross earnings were £552,000. He agreed to provide the wife with a budget of £113,000 for herself and the children. Some years after the agreement the husband’s gross earnings had increased to £1.86m per annum. On the wife’s application for ancillary relief the judge fixed her periodical payments at £120,000 with £12,500 to each of the twins. School fees and extras were agreed to be paid by H direct. She appealed.
