Abuse of process in the Lands Tribunal

Mean Fiddler Holdings Ltd v Islington Borough Council (No 2) Lands Tribunal, 9 September 2003

Following the Court of Appeal’s decision ([2003] 2 EGLR 7 – see (2003) 17 Commercial Leases 736) on a preliminary issue, Mean Fiddler Holdings Ltd v Islington Borough Council (No 2) was heard by the Lands Tribunal (Judge Michael Rich QC and Mr Norman Rose FRICS) on 9 September 2003. At issue in this hearing were intended to be the valuation aspects of the claimant’s claim for compensation for compulsory purchase, the main element being for compensation for total extinguishment of the claimant’s business.
