Winding-up proceedings notwithstanding unresolved litigation

Pedley v James Dolman and Co Ltd Court of Appeal, 25 September 2003

A landlord in dispute with a tenant, against whom he had started possession proceedings, issued, first, a statutory notice and, then, a winding-up petition. The problem for the Court of Appeal (Schiemann, Rix and Arden LJJ) in Pedley v James Dolman and Co Ltd on 25 September 2003 was whether or not to uphold a restriction on advertisement of a winding-up petition granted by the court below.
