Commercial premises – rent reviews – arbitrations

We highlight for readers’ interest a couple of recent cases concerning the conduct of arbitrators undertaking rent reviews. In general terms it is now quite difficult to overturn an arbitrators’ award. The courts tend to take a strict line on what amounts to a serious irregularity in the arbitration process. In the first case we highlight the tenant failed in his challenge, but in the second the tenant succeeded.
