Business tenancy – disrepair – damages and loss of profits

Hawkins v Woodhall and another [2008] EWCA Civ 932

This is an interesting case where the Court of Appeal took the opportunity to review a judge’s decision to award substantial damages to the tenants arising from the landlord’s failure to repair the premises. The facts, while a little unusual, are not uncommon and again illustrate very clearly the dangers of informal, or at any rate, not properly documented arrangements.
