, the ongoing US lawsuit alleging misuse of a photograph of 16 year old Alison Chang by Virgin Mobile from the photo sharing
site Flickr to front an advertising campaign

was analysed in terms of the effectiveness of the Creative Commons Licence. Briefly, Miss Chang had her photograph taken by
a third party who then uploaded the image onto a picture sharing website without her knowledge. Virgin Mobile then used the
image in one of its advertising campaigns with the statement “Dump Your Pen Friend”.
