Wasted costs order

Hallam-Peel & Co v Southwark LBC [2008] EWCA Civ 1120 21 October

A firm of solicitors had not acted unreasonably in raising a new point in possession proceedings, which led to further adjournments and its conduct did not involve a breach of duty to the court. Accordingly, a wasted cost order should not have been made against them and their appeal was allowed.
