Peer International Corporation and others v Editora Musical de Cuba [2008] EWCA Civ 1260 26 November

In an appeal against the refusal of the trial judge to make an order for costs, the defendant contended that the judge should have taken into account that this was a test case affecting the rights in a very large number of Cuban songs composed in the 1930s and 1940s.
