Enforcing part of an award

IPCO (Nigeria) Ltd v Nigerian National Petroleum Corporation CA TLR 11 November

The arbitrators issued an award in favour of the claimant in the net amount of US$152m. The defendant applied to the Federal Court in Nigeria to set aside the award and the claimant applied to the English High Court to enforce it. The application for enforcement was adjourned provided the defendant paid the claimant US$13m. When the claimant renewed his application to enforce the award, they succeeded in respect of part of the award, for over US$85m. The defendant appealed.
