Digicel (St Lucia) Ltd and others v Cable & Wireless Plc and others [2008] EWHC 2522 (CH) (23 Oct)

The claimants were mobile phone companies operating in seven jurisdictions in the Caribbean. The claimant had issued proceedings on the basis that in each jurisdiction the relevant defendant deliberately delayed interconnection with its network by the relevant claimant. Following standard disclosure, the claimant sought specific disclosure of various categories of electronic documents pursuant to CPR 31.12. The defendants responded that they had, by their solicitors, carried out targeted keyword electronic searches as part of their standard disclosure.
