Waltham Forest LBC v Maloba and other [2007] EWCA Civ 1281; SJ 14 December

The claimant had been born in Uganda, but had lived in the UK for many years and had acquired British citizenship. On a visit to Uganda, he met his future wife and married her there, and they remained living in Uganda for two years in an annex to the family home. On his return to the UK with his wife and a young daughter, the local authority refused his application for accommodation on the grounds that he and his family were not homeless, because the house in Uganda was available to them.
